Welcome to VYBZI (the “App”) and its associated website (the “Website”). The App and Website are owned and operated by RFM Investment Group Inc. (“RFM”, “Company”, “we”, “our”, or “us”). 

By accessing, downloading, browsing, registering for, purchasing tickets through, or otherwise using the App or Website, you agree to be bound by these Terms and Conditions (“Terms”). If you do not agree to these Terms, you must not use the App or Website. 

1. About the Platform

The App serves as a digital platform that enables users to discover, browse, promote, share, and access information regarding events, entertainment experiences, festivals, parties, concerts, carnivals, sporting events, excursions, and other activities. The App may also facilitate RSVP functionality and connections between users and event organizers. The App does not act as a ticket seller unless expressly stated otherwise. 

Unless expressly stated otherwise, RFM Investment Group Inc. is not the organizer, operator, manager, sponsor, or host of events listed on the platform. 

2. Eligibility

You must be at least eighteen (18) years old, or the age of majority in your jurisdiction, to create an account or purchase tickets unless otherwise permitted by applicable law. 

By using the App or Website, you represent and warrant that you have the legal capacity to enter into these Terms. 

3. User Accounts

Users are required to create an account to access features. 

You are responsible for: 

• Maintaining the confidentiality of your login credentials; 

• All activities occurring under your account; 

• Providing accurate and current information. 

RFM reserves the right to suspend or terminate accounts that violate these Terms. 

4. Event Discovery, RSVPs, and Third-Party Ticketing

The App serves as a platform for discovering, promoting, and accessing information regarding events, activities, festivals, parties, concerts, carnivals, excursions, sporting events, and other experiences. 

RFM Investment Group Inc. does not sell, process, collect, issue, fulfill, or manage tickets for events unless expressly stated otherwise. 

The App may provide links, redirects, or references to third-party websites, ticketing providers, event organizers, promoters, venues, or service providers through which users may purchase tickets or register for events. Any transaction conducted through a third-party website or service is solely between the user and the applicable third party. 

RFM Investment Group Inc. is not responsible for: 

• Ticket sales or purchases; 

• Ticket availability; 

• Ticket pricing; 

• Refunds or exchanges; 

• Event cancellations or postponements; 

• Event admission decisions; 

• Third-party ticketing platform services. 

Users are encouraged to review the terms, policies, and conditions of any third-party website or service before completing a transaction. 

RSVP Functionality 

The App may provide users with the ability to RSVP to events. 

By submitting an RSVP, you acknowledge and agree that your RSVP information may be shared with the event organizer, promoter, venue, or authorized event representative for purposes related to event administration, attendance management, marketing, communication, and event updates. 

Submitting an RSVP does not guarantee admission, entry, seating, participation, ticket availability, or attendance at any event. 

Event organizers remain solely responsible for managing RSVP lists, admissions, communications, and event operations. 

Organizer Communications 

Certain event organizers may elect to enable communication features through the App. 

By RSVPing to an event or otherwise interacting with an event listing, you consent to being contacted by the event organizer, promoter, venue, sponsor, or their authorized representatives regarding: 

• Event updates; 

• Event reminders; 

• Schedule changes; 

• Promotional offers; 

• Ticket availability; 

• Related event information. 

RFM Investment Group Inc. is not responsible for the content, frequency, accuracy, legality, or conduct of communications sent by event organizers or third parties. 

Users may opt out of organizer communications where such option is provided by applicable law or by the organizer. 

5. 5. Assumption of Risk

By purchasing tickets, attending, participating in, or engaging with any event, activity, venue, excursion, festival, carnival, party, concert, sporting event, or other experience advertised, promoted, sold, or listed through the App or Website, you acknowledge and agree that such participation involves inherent risks. 

These risks may include, without limitation: 

• Personal injury; 

• Illness or disease; 

• Accidents; 

• Physical harm; 

• Property damage; 

• Theft; 

• Loss of personal belongings; 

• Emotional distress; 

• Death; 

• Other unforeseen risks. 

You voluntarily assume all risks associated with attendance and participation. 

6. 6. Release and Waiver of Liability

To the fullest extent permitted by applicable law, you release, waive, discharge, and agree not to hold liable RFM Investment Group Inc., its shareholders, directors, officers, employees, contractors, affiliates, subsidiaries, agents, successors, and assigns from any claims, demands, actions, damages, losses, liabilities, costs, expenses, or causes of action arising from or related to: 

• Attendance at any event; 

• Participation in any activity; 

• Travel to or from an event; 

• Actions or omissions of event organizers, venues, promoters, vendors, sponsors, performers, attendees, or other third parties; 

• Personal injury, illness, disability, death, theft, loss, or property damage. 

This waiver applies regardless of whether such claims arise in contract, tort, negligence, statutory duty, or otherwise, except where prohibited by law. 

7. 7. Third-Party Events and Services

Events, venues, organizers, sponsors, vendors, performers, and service providers featured on the App are generally independent third parties. 

RFM Investment Group Inc. does not: 

• Own or control event venues; 

• Supervise event operations; 

• Guarantee event safety; 

• Verify all information supplied by organizers; 

• Guarantee compliance with applicable laws by organizers. 

Responsibility for event management, safety, staffing, permits, insurance, and legal compliance rests solely with the event organizer or relevant third party. 

8. 8. No Warranty

The App and Website are provided on an “AS IS” and “AS AVAILABLE” basis. 

RFM Investment Group Inc. makes no warranties, express or implied, regarding: 

• Event quality; 

• Event safety; 

• Event legality; 

• Accuracy of event information; 

• Continuous operation of the platform; 

• Availability of tickets; 

• Fitness for a particular purpose. 

Use of the platform is at your own risk. 

9. 9. Limitation of Liability

To the maximum extent permitted by law, RFM Investment Group Inc. shall not be liable for any: 

• Direct damages; 

• Indirect damages; 

• Consequential damages; 

• Special damages; 

• Incidental damages; 

• Punitive damages; 

• Loss of profits; 

• Loss of data; 

• Business interruption; 

• Personal injury; 

• Property damage. 

In any event, the total aggregate liability of RFM Investment Group Inc. arising from your use of the App, Website, or any event shall not exceed the amount paid by you to RFM Investment Group Inc. during the twelve (12) months preceding the claim. 

10. 10. Indemnification

You agree to defend, indemnify, and hold harmless RFM Investment Group Inc., its officers, directors, employees, contractors, affiliates, and agents from and against any claims, losses, liabilities, damages, judgments, costs, penalties, and expenses, including reasonable attorneys’ fees, arising out of: 

• Your use of the App or Website; 

• Your attendance at an event; 

• Your participation in an activity; 

• Your violation of these Terms; 

• Your conduct toward other users or third parties. 

11. 11. User Conduct

Users shall not: 

• Violate any law or regulation; 

• Use the platform fraudulently; 

• Upload malicious software; 

• Infringe intellectual property rights; 

• Harass, threaten, or abuse other users; 

• Interfere with platform operations. 

RFM reserves the right to suspend or terminate access for violations. 

12. 12. Intellectual Property

All trademarks, logos, designs, graphics, software, content, and branding associated with the App and Website are the property of RFM Investment Group Inc. or its licensors. 

No content may be copied, reproduced, modified, distributed, or used without prior written permission. 

13. 13. Privacy

Your use of the App and Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference. 

14. 14. Changes to Terms

RFM Investment Group Inc. reserves the right to modify these Terms at any time. 

Continued use of the App or Website following any changes constitutes acceptance of the revised Terms.
